The Regina Police Service reports a 62 year-old male, who is the subject of an 810.2 Recognizance, has been charged with a breach of conditions of the recognizance. This type of recognizance is identified in Section 810.2 of the Criminal Code of Canada, which provides for a situation where a police officer, fearing that another person will commit a serious personal injury offence, may seek to lay an Information before a Provincial Court Judge requesting a hearing. If the Judge is satisfied by the evidence presented by the informant (police), then the Judge can order the defendant to enter into a recognizance to keep the peace and be of good behaviour. The Provincial Court Judge can add conditions that he or she feels are necessary to secure the defendant’s good conduct. In this case, the subject of this 810.2 Recognizance had a condition that prohibited him from attending areas of the City where sex trade workers may be encountered, without lawful reason to be there, e.g. for work purposes. The prohibited area would have been specified by the individual’s probation officer.
On February 24, 2013, police observed a truck, driven by an adult male identified as the 62 year-old subject of the 810.2 Recognizance. The vehicle was observed driving in an area of the city specified as prohibited to this individual unless he had lawful reason to be there. Further investigation by police determined that the male had no lawful reason for being in the area. On February 25, 2013, this 62 year-old male was arrested without incident and charged with Breach of the conditions of his 810.2 Recognizance.
Sixty-two year-old Brian Kenneth SOLBERG, DOB: 1951-02-07, of Regina, is charged with Breach of Recognizance under section 810 [811 CC]. SOLBERG made an appearance in Provincial Court at 9:30 a.m. today, Tuesday, February 26, 2013.
